PACE-compliant Arabic interpretation

The Police and Criminal Evidence Act 1984 (PACE) and its Codes of Practice set out clear requirements for the use of interpreters in suspect interviews. An interpreter who does not understand these requirements โ€” or whose Arabic is not equal to the demands of a contested interview โ€” is a procedural liability for the defence and a risk to the integrity of the investigation.

Suspect interviews โ€” the linguistic risks

Three patterns I see regularly that compromise the evidential value of an Arabic-language interview:

  • Dialect mismatch. A Yemeni or Sudanese-speaking suspect interpreted by an MSA-only or Levantine-only interpreter often gives answers that read as inconsistent on transcript when the cause is purely linguistic.
  • Cultural register. Indirect speech patterns common in Gulf and Yemeni Arabic can read as evasive when rendered too literally into English.
  • Untrained simultaneous mode. Some interpreters paraphrase under pressure rather than rendering each utterance โ€” destroying the evidential record.
