If you are seeking asylum in the UK and receiving Section 95 support from the Home Office — accommodation, a weekly allowance, or both — this briefing explains two rights that many asylum seekers do not know they have: the right to free legal representation, and the right to a professional interpreter who speaks your dialect.
What is Section 95 support?
Section 95 of the Immigration and Asylum Act 1999 allows the Home Office to support asylum seekers who would otherwise be destitute while their claim is decided. It can include somewhere to live, a weekly payment for essentials, or both. If you receive this support, it is a strong indication that you also qualify for legal aid.
You are entitled to a solicitor — free of charge
Asylum and refugee claims are covered by legal aid in England and Wales. A qualified immigration solicitor can represent you at no cost to you, provided you pass the means test — and people receiving asylum support almost always do. A solicitor can prepare your case, gather evidence, guide your claim through the Home Office process, and represent you at appeal if needed.
You do not need to face the asylum process alone, and you should never pay an unqualified "adviser". Always use a solicitor regulated by the Solicitors Regulation Authority (SRA) or an immigration adviser registered with the relevant regulator.
You are entitled to a professional interpreter — in your own dialect
At your Home Office interviews, an interpreter is provided. At appointments with your solicitor, your solicitor can arrange a professional interpreter, funded through legal aid.
This matters more than many people realise. Arabic is not one language in practice — a Yemeni, Sudanese, Syrian or Iraqi speaker each brings a distinct dialect, and dialect mistakes can change the meaning of testimony. In an asylum claim, where your account is the evidence, precision is everything. You are entitled to ask for an interpreter who genuinely understands your dialect — and to say so if you cannot follow the interpreter provided.
How to check an interpreter is properly qualified
Professional legal interpreters in the UK are registered with the National Register of Public Service Interpreters (NRPSI). Anyone can check the register free of charge at nrpsi.org.uk. A registered interpreter is bound by a strict code of professional conduct, including complete confidentiality and impartiality.
